Rhode Island Department of Motor Vehicles Identity Verification: Identity-Fraud Risks and System Reliability

Reported cases of identity fraud, considered together with deficiencies in management controls, have prompted scrutiny of digital identity checks in Rhode Island. Such findings make one question particularly relevant: do they prove that identity-checking technology is failing? The documented record suggests a more complicated picture.

1. Findings from Rhode Island’s DMV Review

On December 31, 2025, Rhode Island’s Office of Internal Audit and Program Integrity issued an audit of the Department of Motor Vehicles (DMV) controls governing payments accepted at DMV locations. The review examined the period from July 2024 through June 2025 and assessed 240 samples across 60 transaction days.

Auditors examined payment collection, payment reconciliation processes, recordkeeping, access requirements, and controls governing third-party partners.

Gaps in External Partner Supervision

The DMV relied on AAA Northeast, Legatus Solutions Corporation, and 25 automobile dealerships to provide specific DMV-related services.

The audit found that the DMV used a payment-handling policy for dealerships but lacked a formal policy governing its oversight of AAA Northeast and Legatus in this area. Some payment records also were missing review signatures.

Auditors recommended more clearly defined duties, standardized documentation, and regular monitoring.

Inconsistencies in Personnel Records

For sampled AAA Northeast personnel, the DMV required confidentiality agreements. For Legatus, auditors identified inconsistencies in screening and confidentiality procedures for employees with limited access to a financial management system. Some requested records were not provided promptly.

These findings reveal shortcomings in specific management controls. However, the audit did not test automated counterfeit-identification tools, facial-recognition systems, or license-scanning equipment.

Documented Findings Questions Left Unanswered
Some administrative and third-party oversight controls were inconsistently documented or applied. That counterfeit documents bypassed the state’s automated checks.
Auditors recommended improvements to documentation and oversight. The error rate of Rhode Island’s identity-verification technology.

The audit identifies genuine administrative issues. It does not, however, demonstrate a technical failure in automated identity verification.

2. Criminal Cases Illustrating Identity Fraud

Several federal cases illustrate how false credentials and another person’s identity details have been used in documented offenses.

Counterfeit Licenses in a Retail Scheme

In February 2024, federal prosecutors reported the sentencing of Alexandre Henrique Costa-Mota in a multistate retail fraud scheme involving Home Depot.

According to the U.S. Department of Justice, Costa-Mota admitted guilt to wire fraud and conspiracy. Between mid-2021 and early 2022, the scheme involved merchandise theft and repeated returns for store credit.

Prosecutors reported at least 60 transactions across 40 or more stores, involving approximately $297,332 in store credit. Fake driver’s licenses were used to reduce the likelihood of detection.

The case confirms that fraudulent identification formed part of a documented fraud operation. However, the public announcement does not name a particular verification tool, nor does it establish that an automated system incorrectly approved a counterfeit document.

Stolen Identities Used to Obtain Benefits

In April 2025, prosecutors announced that Pawtucket resident Reynaldo Martinez had admitted to defrauding federally funded benefit programs and the U.S. Treasury.

According to the government, Martinez obtained at least 40 Supplemental Nutrition Assistance Program (SNAP) electronic benefit transfer cards using personal identity information obtained unlawfully.

He submitted applications using fraudulent driver’s licenses bearing his own photograph but identity information associated with other people. Prosecutors reported that he fraudulently obtained at least $33,192.36 in SNAP benefits. A separate scheme involving altered Treasury checks accounted for approximately $79,532.32.

The case demonstrates a significant limitation: information can be readable without accurately representing the person presenting the document. Nevertheless, the public record does not establish what specific verification procedures were used or whether specific technology failed.

A Further Identity-Fraud Case

In May 2026, federal prosecutors announced an indictment against Felipe Almonte Polanco in an alleged SNAP fraud scheme involving identities belonging to living and deceased individuals. The government estimated approximately $69,000 in fraudulent benefits.

An indictment presents accusations rather than proof of guilt. The defendant is considered innocent unless guilt is established.

As with the earlier cases, the announcement does not establish that Rhode Island DMV’s verification system was used.

3. Five Essential Steps in Identity Checks

Identity verification involves several distinct checks. A successful result at one stage does not guarantee success at every other stage.

Process Primary Function
Information reading Read information printed or encoded on a document.
Document assessment Determine whether the document appears authentic under the checks performed.
Identity matching Determine whether the presenter corresponds to the represented identity.
Record validation Compare relevant information with trusted sources where appropriate.
Transaction approval Determine whether the person may complete the requested transaction.

A counterfeit document may contain information that can be scanned, while a genuine license may be unreadable to a scanner because it is damaged. A document may also appear authentic but be presented by an unauthorized person.

Even when identity is confirmed, a separate decision may still be required to permit an account change.

These distinctions explain why proof of identity misuse cannot independently establish the precise point of technical failure.

4. The Benefits and Limitations of Facial Recognition

The American Association of Motor Vehicle Administrators (AAMVA) describes facial recognition as an automated method of comparing facial images against a biometric database. The organization reports that the technology is common among North American motor-vehicle authorities.

AAMVA emphasizes that trained personnel should review potential matches and associated records to determine whether further investigation is necessary.

Facial recognition can generate inaccurate matches or overlook meaningful similarities. Its performance depends on image clarity, database coverage, system conditions, and oversight practices.

However, general industry guidance does not establish what specific facial-recognition tools the state employs, or the state’s specific biometric error rate.

An independent evaluation would need testing focused on Rhode Island’s own systems, documented measurements of false approvals and false denials, and evidence showing how ambiguous outcomes are reviewed.

5. Fraud Laws and Replacement Options

Rhode Island General Laws § 11-49.1-3 addresses specified conduct involving fraudulent identity documents and unlawful use of another individual’s identity information. Sections 3-8-6.2 and 3-8-6.3 address specified unlawful uses of official identification cards and the creation or distribution of fraudulent identification credentials.

Applicable offenses and penalties depend on the facts of the case and the statutes involved.

A document’s ability to pass a scan does not render it lawful. Similarly, a scanning failure alone does not demonstrate that a crime was intended.

Residents who lose or damage their licenses should use the official DMV replacement process and confirm the applicable requirements and current fees. If a license is stolen, obtaining a replacement and reporting potential identity fraud are distinct actions.

6. What Evidence Is Needed to Assess Accuracy?

The available records do not answer the central technical question: how effectively do Rhode Island’s automated systems separate genuine credentials from fraudulent documents?

A credible independent assessment should examine:

  • The document-authentication and identity-matching procedures in use.
  • The measured rates of incorrect acceptance and rejection.
  • Testing methods and operating conditions.
  • The review process for uncertain verification outcomes.
  • Permission management for staff and external service partners.
  • Documentation confirming implementation of the audit’s recommendations.

Proposed completion dates do not prove that corrective measures were implemented. Additional records are needed to verify implementation.

Without technical performance data, assigning a numerical reliability rating to Rhode Island’s verification systems would be speculative.

Conclusion: Evidence Requires Scrutiny, Not Assumptions

The available records demonstrate three key facts. First, fraudulent driver’s licenses and stolen identities have been used in reported criminal schemes involving retail transactions and public benefits. Second, Rhode Island’s 2025 DMV audit identified weaknesses in certain administrative procedures, including third-party oversight and records associated with personnel access. Third, neither the audit nor the criminal cases establishes a quantified error rate for automated driver’s-license verification.

Effective identity protection depends on a combination of security measures: document examination, presenter verification, authoritative database checks, transaction authorization, and reliable administrative supervision.

Although automated identity checks can provide valuable protection, their accuracy in Rhode Island remains unquantified by the available evidence. A publicly documented independent assessment is needed to measure performance and determine whether the previously identified oversight gaps have been corrected.
